ORLANDO, Fla. – The family of Michelle Parker, the Central Florida mother who vanished in 2011, has filed a wrongful death lawsuit against her ex-fiance -- the prime suspect in her disappearance.
John Morgan's firm, Morgan & Morgan, said Thursday that a lawsuit has been filed against Dale Smith Jr.
Smith, who was the last person to see Parker, has custody of their twins and has not been arrested.
The lawsuit alleges Smith is responsible for the death of Parker, who was last seen in November 2011.
"I think what its done for the family is ripped it apart," said Morgan of the investigation's progress. "This is really about accountability and people answering questions that really haven't been answered yet."
The lawsuit alleges "on November 17, Smith was negligent or otherwise committed a wrongful act and caused the death of Michelle Parker."
Parker was reported missing after the airing of a pre-recorded episode of the TV show "The People's Court," which featured the two in a dispute over her engagement ring.
Morgan said the lawsuit is about getting Smith to talk.
Yvonne does not believe that there's been cooperation the way there should be," Morgan said. "I don't believe the police believe there has been either."
Attorney Mark NeJame represents Smith and says that Smith has told all that he knows.
"There's simply nothing that links Dale Smith to Michelle Parker's disappearance or death," NeJame said. "It's not going to go anywhere. This is going to be an exercise in futility."
Several searches have been launched in an effort to locate Parker, but none has been successful.
