Man now in jail, woman remains in hospital after Brevard car burglary ends in deputy shooting

Deputy wounded woman with gun Wednesday, sheriff says

BREVARD COUNTY, Fla. – One of the two people at the center of an incident that ended with a deputy shooting one of them in Palm Shores Wednesday is now in jail.

On Friday, Tim Frane walked into the jail courtroom in Sharpes on his 37th birthday.

Judge Tesha Ballou read the list of charges Frane is, facing including aggravated assault on a law enforcement officer with a weapon or firearm.

On Wednesday, Sheriff Wayne Ivey said a woman who was with Frane had a gun.

The sheriff said deputies came to US-1 near the Jimmy Hula’s restaurant to stop a car burglary.

That’s when the sheriff says the two people hid in the woods. He said the woman showed the gun so a deputy shot her.

Court records Friday showed a six-page arrest affidavit was not available to the public yet.

When that’s ready, it should tell us more about what happened and Frane’s involvement.

Judge Ballou ordered that Frane not have any contact with the co-defendant and he’s also not allowed to have guns or ammo.

At the jail, Judge Ballou also said Frane violated his probation. He was convicted in May of having fentanyl.

The woman who was shot is still in the hospital. The sheriff’s office hasn’t released her name publicly.

Frane is still in jail without bond.
