U-turning at a median opening. Who has the right of way?

ORLANDO, Fla. – News 6 traffic safety expert Trooper Steve Montiero answers viewer questions and shares tips about the rules of the road, helping Central Florida residents become better drivers by being better educated.

Kate on Thursday asked, “When making a U-turn mid block, does the U-turn have the right of way or someone waiting at a side stop sign?”

Trooper Steve said the first thing to determine is who has the primary traffic control device.

“Someone who has a stop sign has two separate obligations. The first one is to conduct a complete stop at the stop sign. The second portion would be to yield right of way to anyone beyond that stop sign,” he said.

The driver who is entering the median in order to make either a left turn or to conduct a U-turn is obligated to yield to oncoming traffic.

“This would be much different than conducting a stop. The driver in the median would have the right of way to conduct their movement before the driver at the stop sign. Meaning, the driver at the stop sign would have to yield right of way to either traffic approaching them from the oncoming direction or traffic in the median conducting a U-turn.”
