BREVARD COUNTY, Fla. – A man accused of fatally shooting someone at a Melbourne sports bar in 2022 was arrested this week, accused of DUI.
Elvin Clark, 30, violated his conditional release while awaiting a trial date for charges of second-degree murder, aggravated battery with a deadly weapon and possession of a firearm by a convicted felon, all stemming from the March 2022 shooting at Off The Traxx which took the life of Alain Noel, 34, police said.
A lawyer for Noel’s family argued that June that Clark was “an absolute danger to the community” and shouldn’t be let out on bond, yet he was in August 2022. One condition of Clark’s release was to follow a 9 p.m. to 6 a.m. curfew which was modified Oct. 23 of this year to last from 10 p.m. to 5 a.m., records show.
Clark was stopped on Dairy Road on Tuesday by a Melbourne police officer who reported seeing him take a wide turn in a pickup truck without headlights on and strike a curb around 9:55 p.m.
The officer said that Clark showed signs of impairment while performing field sobriety exercises and was out past curfew regardless, issuing him a DUI citation and a citation for driving without headlights before turning him over to the Brevard County jail, an arrest affidavit states.

Clark will be back in court Jan. 17, 2024, concerning the 2022 shooting. He was one of three arrested in Noel’s killing, part of a group accused of attacking the people Noel was with before he was shot in the packed bar. A bartender was struck in the leg as well, suffering non-life-threatening injuries as more than 300 patrons rushed to escape.
