Former employee accuses Orange County Chuck E. Cheese in sex attack claims

Lawsuit accuses restaurant of negligence due to employee’s claims of sexual assault

ORANGE COUNTY, Fla. – A woman is suing a Chuck E. Cheese restaurant in Orange County after a reported sex attack over four years ago, according to court documents filed on Wednesday.

The lawsuit says that in May 2019, the woman — referred to anonymously as “Jane Doe” — was 16 years old and employed by the restaurant, located at 7419 International Drive.

At that time, another employee — Emmanuel Perez Montalvo, 29 — began giving Doe rides home from work “in an effort to gain her trust and groom her,” the lawsuit claims.

During one of these rides, Montalvo began to “forcibly kiss” Doe despite her telling him to stop, and after she rejected him, he dropped her off at her home, the lawsuit states.

“Perez Montalvo continued to sexually assault (Doe) on every subsequent ride home when she was scheduled to work,” the lawsuit reads. “Perez Montalvo would fondle (Doe) over and under her clothes, he would penetrate (Doe) vaginally, anally and orally. Anytime (Doe) refused or attempted to resist being assault, Perez Montalvo would get violent and strike her until she complied.”

According to the lawsuit, this continued until Doe left her position in February 2020.

Later that year, Montalvo was taken into custody on charges of sexual activity with a 16-year-old or 17-year-old.

However, an arrest report shows that Montalvo denied many of the claims made by the victim. The charges were later dropped by prosecutors in 2022.

Despite that, the lawsuit accuses Chuck E. Cheese of negligence and premises liability, saying that the restaurant was aware of Montalvo’s “inappropriate conduct during his employment.”

“Upon information and belief, (Chuck E. Cheese) had notice of Perez Montalvo’s inappropriate sexual conduct toward (Doe) prior to her sexual assault,” the lawsuit reads.

In addition, the lawsuit claims that Doe is seeking damages over $1 million.
