1 injured when gunfire erupts at Orange County apartment

ORANGE COUNTY, Fla. – A 23-year old man is accused of shooting at a former friend and his father multiple times on Sunday, according to an Orange County arrest affidavit.

Police said they responded around 7 p.m. to an apartment complex located at 5325 Curry Ford Road in reference to shots being fired in the area.

According to the affidavit, a man told police that his father had been shot and officers at the scene started to tend to the man who was hit in the hand.

The victim’s son stated that his father, who was at the Coin Laundry Room across the street from their residence, called him to say a man – identified as 23-year-old Darian Vega – flashed his gun at him and asked his son to “bring him his gun.”

The man told police that he grabbed his father’s gun and went outside to meet him when Vega walked past him on a property sidewalk leading to south Curry Ford Road.

According to the affidavit, the man looked back over at Vega several times as they walked away from each other and on the third look back, he saw Vega reach for his gun before he was shot at two to three times.

Police said the man then fired two to three times back at Vega with his father’s gun before Vega turned away and ran between the apartment buildings.

The man and his father returned to their apartment when they told police that they heard gunshots and “bullets began entering through the rear sliding door and the kitchen window,” the affidavit shows.

According to the affidavit, the father grabbed his gun to return fire from the kitchen before his son heard him say that he had been shot.

Police said the son stated that gunshots stopped coming from the back door but started coming in the front window.

The son also told responding officers that he and Vega used “to be friends but now there was a falling out of the friendship.” He also stated that the back of his apartment was “shot up” about a month ago but wasn’t sure who was responsible.

According to the affidavit, Vega fled the scene in a northbound direction by the time officers arrived and K-9 units, a sheriff’s office helicopter and other law enforcement officers were called to help locate the suspect.

Police said during the search, Vega called 911 to state that someone shot at him and he returned fire but instead of staying at the location of his phone call, he left.

A nearby resident called 911 and reported that Vega was at his residence but left after he told the suspect to leave.

Vega was eventually captured with the help of a K-9 unit on Wavecrest Drive, according to the affidavit. Police said during the arrest, two firearms and four semi-automatic firearm magazines were located on him.

Police also said Vega was transported to the hospital due to a gunshot wound and dog bites.

According to the affidavit, when Vega is released from the hospital, he faces charges of attempted felony murder with firearm/discharge, aggravated battery with a firearm and throwing/shooting into an occupied dwelling.
