Read the fine print: Disney wrongful death lawsuit sparks concern

ORALNDO, Fla. – Disney lawyers say a lawsuit following the death of a New York doctor from an allergic reaction, should be tossed out because her widower signed up for a Disney+ account years earlier.

It brings to light the fine print that people sign on a regular basis, without understanding the terms of what is being agreed upon.

Attorney Ray Traendly from TK Law says you always need to read and understand the fine print when you agree to a company’s terms and conditions.

We’ve all had to deal with trying to sign up or pay for something online, and then finding ourselves scrolling through pages of legal terms.

Even if you haven’t read it or don’t understand the “terms and conditions”, you are still liable if you click the “yes” box.

Most of these agreements are take it or leave it.

If you don’t opt into their agreement, you can’t access their products and services.

Consumer advocates recommend looking for terms like “binding arbitration” and “class action waiver”.

In many cases, if you agree to those terms, you may not have a right to a court case if something goes wrong.

It might force you to resolve your dispute in a secret arbitration that favors the company. And it even possibly stops you from getting together with other people who have the same problem and filing a class action lawsuit.

“My caution to people is before you click “I agree” or " I subscribe”, is to actually look at those terms and conditions and understand what you could be potentially giving up, by clicking that box,” said Traendly.
