New details released in Winter Springs rape case

DNA found in underwear of girl who says she was gang raped, documents say

SANFORD, Fla. – DNA from two Winter Springs High School students was found inside the underwear of a female student who claims they gang raped her last November, according to court documents.

Those documents were obtained by Local 6 Monday, and they detail what evidence investigators have collected in the case that accuses a total of five male students of gang rape.

According to the documents, the DNA of Deoante Stewart and Marquis Pierre was found inside the underwear of the accuser.

The victim also identifies Stewart as the boy who vaginally raped her.

Stewart and Pierre are being tried as adults in the case.

The documents show DNA from the three juveniles charged in the case was found on other areas of the victim, including her clothing, a headband and her mouth.

"When you find DNA evidence is inside the girls underwear and when there's DNA evidence on her headband, on her sweatshirt, on her sweatpants --something like that -- it makes it a much more clear-cut issue. And that issue now is was the encounter consensual or not?" said legal expert Steven Kramer.

Winter Springs police investigators also wrote that one of the juveniles told police the victim told them, "no," when they asked her for sex.

The victim told police the incident happened on November 13 in a wooded area near Winter Springs High School.

She said the boys pulled her into the woods, where they told her they wouldn't let her go unless she performed oral sex on them.

Part of the evidence in the case is iPod video the victim recorded during the incident.
Court documents indicate the video shows the boys circling the victim, and they could hear her saying, "no."

The video was not released as part of Monday's discovery, but it will likely be used as evidence in court when the cases make it to trial.
