ORLANDO, Fla. – News 6 traffic safety expert Trooper Steve Montiero answers viewer questions about the rules of the road, helping Orlando-area residents become better drivers by being better educated.
Trooper Steve on Thursday was asked by Stacy, “Can I throw biodegradable items out of my window while driving or is that considered littering?”
Trooper Steve said throwing items out of your car is illegal.
“Even if it was legal, I don’t understand why you would just want to leave your trash out and about for either nature to take its course or someone to pick up,” he added.
Florida’s “litter law” is a rather long statute, and it does not allow any exceptions.
“As a driver or occupant of a vehicle, you cannot throw anything out of your vehicle at any time,” he said. “What comes into your vehicle must be properly disposed of by the occupants.”
Trooper Steve said the law is in place to cut down on litter -- and for safety reasons.

“To a driver, throwing a banana peel may seem like not a big deal, but this could be an obstruction to a bicyclist or another motorist,” he said. “Bring a bag with you and take care of your trash properly.”
