Store owner fires 'warning' shots in altercation with customer, police say

Daytona Beach shooting investigated

DAYTONA BEACH, Fla. – Two men were arrested after shots were fired at a Stop N Save store in Daytona Beach.

The shooting occurred around 12:50 p.m. Saturday at 1096 Mason Ave.

Officials said Marvin Stinson, 50, went into the store to use the restroom but was told by the owner, Vikesh Patel (pictured, left), 29, that the restroom was not open.

Stinson reportedly became angry and a verbal altercation ensued, which led to Stinson knocking merchandise off the shelves before being told to leave.

Officials said Hemant Patel (pictured, right), 26, followed Stinson out of the store and a physical altercation began between the two men.

A 9mm firearm that Hemant Patel had in his pants fell out during the altercation and Stinson picked it up and returned it to Vikesh Patel before turning to leave.

Officials said Vikesh Patel then fired two "warning" shots from the gun into the air.

Stinson told police he believed the shots were being fired at him and feared for his life.

Police said a witness verified that Hemant Patel was the primary aggressor, intentionally striking Stinson during the physical altercation.

Police recovered two firearms and shell casings from outside the store.

Vikesh Patel was charged with aggravated assault with a deadly weapon without intention to kill, a felony.

Hemant Patel was charged with battery by touching or striking a misdemeanor.
